Every project is different, but these concise answers explain the usual starting point. They are general information rather than project-specific legal advice.
Ask a questionThe building owner normally pays the reasonable costs associated with the party wall process, including the adjoining owner’s surveyor where one is properly appointed. The position can vary and should be checked for the specific project.
A neighbour can dissent from a notice, but cannot simply prevent lawful notifiable work. Dissent triggers the Act’s dispute-resolution procedure and appointed surveyors may make a Party Wall Award.
The period depends on the work. Certain party structure works generally require two months’ notice, while line of junction and adjacent excavation notices generally require one month. Seek advice before work starts.
Not every extension is notifiable. Excavation near neighbouring foundations, work to a shared wall or construction at the boundary may fall within the Act. A drawing review is the safest starting point.
The building owner may lose important statutory protections and the adjoining owner may consider legal remedies. Urgent professional advice should be obtained before further work proceeds.
